Kullanım Şartları

Bu Kullanım Şartları, Booksses web sitesi, mobil uygulamaları ve Booksses’e bağlı dijital hizmetlerin kullanımına ilişkin kuralları düzenler. Booksses’i kullanan, hesap oluşturan, içerik okuyan, içerik yayınlayan, yorum yapan, satın alma işlemi gerçekleştiren veya platformdaki herhangi bir hizmetten yararlanan herkes bu şartları kabul etmiş sayılır. Bu şartları kabul etmeyen kullanıcıların Booksses hizmetlerini kullanmaması gerekir.

Platformun Tanımı

Booksses, kullanıcıların dijital hikâye ve kitap içeriklerini okuyabildiği, yazabildiği, paylaşabildiği, toplulukla etkileşim kurabildiği ve uygun hallerde fiziksel kitap ürünlerine erişebildiği dijital bir okuma ve yayın platformudur.
Booksses, kullanıcılar tarafından oluşturulan içeriklerin sahibi değildir. Kullanıcılar tarafından platforma yüklenen içeriklerin sorumluluğu ilgili kullanıcıya aittir.

Üyelik ve Hesap Güvenliği

Booksses’in bazı özellikleri üyelik gerektirebilir.
Kullanıcı, hesap oluştururken doğru, güncel ve kendisine ait bilgileri kullanmakla yükümlüdür.
Kullanıcı, hesabının güvenliğinden ve hesabı üzerinden yapılan işlemlerden sorumludur.
Hesabın yetkisiz kullanıldığının düşünülmesi halinde kullanıcı, durumu Booksses’e bildirmelidir.
Booksses, sahte, yanıltıcı, kötüye kullanım amacı taşıyan veya platform güvenliğini tehlikeye atan hesapları askıya alabilir veya kapatabilir.

Kullanıcı Sorumlulukları
Kullanıcılar Booksses’i kullanırken aşağıdaki kurallara uymakla yükümlüdür:

1. Hukuka uygun davranmak
2. Üçüncü kişilerin haklarına saygı göstermek
3. Telif hakkı, marka hakkı ve kişilik haklarını ihlal etmemek
4. Yanıltıcı veya sahte bilgi paylaşmamak
5. Platform güvenliğini bozacak işlem yapmamak
6. Başka kullanıcıları taciz, tehdit veya hedef göstermemek
7. Spam, kötüye kullanım veya otomatik işlem faaliyetlerinde bulunmamak
8. Yaşa uygun olmayan içeriklere erişim için yanlış beyanda bulunmamak

Yazar ve İçerik Üretici Sorumluluğu

Booksses’te içerik yayınlayan kullanıcılar, yayınladıkları içeriklerin tüm sorumluluğunun kendilerine ait olduğunu kabul eder.

Yazar veya içerik üretici:
1. İçeriğin kendisine ait olduğunu veya yayınlama hakkına sahip olduğunu kabul eder.
2. İçeriğin üçüncü kişilerin telif hakkını ihlal etmediğini kabul eder.
3. İçeriğin hukuka ve topluluk kurallarına uygun olduğunu kabul eder.
4. Başkasına ait kişisel verileri izinsiz paylaşmamayı kabul eder.
5. İçeriğe ilişkin gelebilecek yasal taleplerden sorumlu olduğunu kabul eder.

Booksses, yayınlanan içerikleri önceden kontrol etmek zorunda değildir. Ancak gerekli gördüğü hallerde içerikleri inceleyebilir, görünürlüğünü azaltabilir, erişime kapatabilir veya kaldırabilir.

Dijital İçerikler ve Coin Kullanımı

Booksses’te bazı dijital içeriklere erişim ücretsiz olabilir. Bazı dijital içerikler ise coin, üyelik, ödeme veya platform tarafından belirlenen başka bir erişim yöntemiyle açılabilir.
Coin, Booksses platformu içinde dijital içerik erişimi, bölüm açma veya belirli dijital hizmetlerden yararlanma amacıyla kullanılan platform içi dijital değerdir.
Coin nakit para, elektronik para, kripto varlık, yatırım aracı veya para yerine geçen genel ödeme aracı değildir.
Kullanıcı, coin kullanarak eriştiği dijital içeriğin mülkiyetini devralmaz. Kullanıcı yalnızca kişisel, sınırlı ve devredilemez bir erişim hakkı elde eder.
Booksses, coin kullanım alanlarını, kampanyaları, promosyonları ve erişim koşullarını değiştirme hakkını saklı tutar.

Mobil Uygulama Satın Alımları

Booksses mobil uygulamasındaki dijital içeriklere ilişkin bazı satın alımlar Apple App Store veya Google Play üzerinden gerçekleştirilebilir.
Bu işlemlerde ödeme, iade ve iptal süreçleri ilgili uygulama mağazasının politikalarına tabi olabilir.

Fiziksel Kitap Satışları

Booksses üzerinde fiziksel kitap ürünleri satışa sunulabilir.
Fiziksel kitap satışlarında satıcı, ilgili ürün detay sayfasında açıkça belirtilen Satıcı Marka’dır.
Booksses, fiziksel kitap satışlarında aracı hizmet sağlayıcı olarak hareket eder.
Ürünün tedariki, paketlenmesi, teslimatı, faturalandırılması, iade ve cayma işlemleri ilgili Satıcı Marka’nın sorumluluğundadır.
Booksses, kullanıcı ile Satıcı Marka arasındaki talep, bildirim ve iletişim sürecinin yürütülmesine yardımcı olabilir.

Cayma ve İade Süreçleri

Fiziksel kitap satın alan tüketici, ilgili mevzuatta belirtilen şartlar kapsamında cayma ve iade hakkını kullanabilir.
Cayma, iade, teslimat ve fatura süreçleri ilgili Satıcı Marka tarafından yürütülür.
Booksses, talebin ilgili Satıcı Marka’ya iletilmesine yardımcı olabilir.

Yasaklı Kullanımlar
Booksses üzerinde aşağıdaki davranışlar yasaktır:

1. Hukuka aykırı içerik paylaşmak
2. Telif hakkı ihlali içeren içerik yüklemek
3. Başkasına ait içeriği izinsiz yayınlamak
4. Başka kullanıcıların hesaplarına erişmeye çalışmak
5. Platformun teknik altyapısını bozmak
6. Bot, otomasyon veya veri kazıma araçlarıyla izinsiz işlem yapmak
7. Sahte hesap oluşturmak
8. Başkası adına işlem yapmak
9. Taciz, tehdit, hakaret veya hedef gösterme içeren davranışlarda bulunmak
10. Spam, yanıltıcı reklam veya dolandırıcılık amacıyla platformu kullanmak
11. Çocuk güvenliğini tehlikeye atabilecek davranışlarda bulunmak
12. Booksses’in itibarını, güvenliğini veya işleyişini kötüye kullanmak

Telif Hakları

Booksses, telif haklarına ve eser sahiplerinin haklarına saygı duyar.
Kullanıcılar yalnızca kendilerine ait olan veya yayınlama hakkına sahip oldukları içerikleri platforma yükleyebilir.
Telif hakkı ihlali bildirilen içerikler incelenebilir ve gerekli görülürse geçici olarak erişime kapatılabilir veya kaldırılabilir.
Telif hakkı ihlalinden kaynaklanan sorumluluk, ihlali gerçekleştiren kullanıcıya aittir.

Moderasyon ve Hesap İşlemleri

Booksses, platform düzenini, kullanıcı güvenliğini ve telif haklarını korumak amacıyla içerikler ve hesaplar üzerinde işlem yapabilir.

Bu kapsamda aşağıdaki işlemler uygulanabilir:
1. Uyarı gönderme
2. İçeriğin düzenlenmesini isteme
3. İçeriğin görünürlüğünü azaltma
4. İçeriği geçici olarak erişime kapatma
5. İçeriği tamamen kaldırma
6. Hesabı geçici olarak askıya alma
7. Hesabı kalıcı olarak kapatma

Sorumluluğun Sınırlandırılması

Booksses, platform hizmetlerini güvenli ve kesintisiz sunmak için makul çabayı gösterir. Ancak teknik arızalar, bakım çalışmaları, internet kesintileri, üçüncü taraf hizmet sağlayıcı sorunları veya mücbir sebepler nedeniyle hizmetlerde kesinti yaşanabilir.
Booksses, kullanıcılar tarafından oluşturulan içeriklerin doğruluğunu, eksiksizliğini veya hukuka uygunluğunu garanti etmez.
Booksses, Satıcı Marka tarafından satılan fiziksel ürünlerin tedariki, teslimatı, faturalandırılması ve satış sonrası süreçlerinden doğrudan sorumlu değildir.

Değişiklik Hakkı

Booksses, Kullanım Şartları’nı hizmetlerdeki değişiklikler, teknik gereklilikler veya yasal düzenlemeler doğrultusunda güncelleyebilir.
Güncel metin web sitesi üzerinden yayımlandığı tarihte yürürlüğe girer.
Kullanıcının güncellenmiş şartlardan sonra platformu kullanmaya devam etmesi, güncel şartları kabul ettiği anlamına gelir.

Uygulanacak Hukuk

Bu Kullanım Şartları’ndan doğabilecek uyuşmazlıklarda Türkiye Cumhuriyeti hukuku uygulanır.
Tüketici işlemleri bakımından ilgili mevzuatta öngörülen tüketici hakları saklıdır.

These Terms of Use set out the rules regarding the use of the Booksses website, mobile applications, and digital services connected to Booksses. Anyone who uses Booksses, creates an account, reads content, publishes content, leaves comments, makes a purchase, or benefits from any service on the platform is deemed to have accepted these terms. Users who do not accept these terms should not use Booksses services.

Definition of the Platform

Booksses is a digital reading and publishing platform where users can read, write, share, interact with the community, and, where applicable, access physical book products.

Booksses does not own the content created by users. The responsibility for content uploaded to the platform by users belongs to the relevant user.

Membership and Account Security

Some features of Booksses may require membership.

When creating an account, the user is responsible for providing accurate, up-to-date, and personal information.

The user is responsible for the security of their account and for all actions carried out through their account.

If the user believes that their account has been used without authorization, they must notify Booksses.

Booksses may suspend or close accounts that are fake, misleading, intended for abuse, or that endanger the security of the platform.

User Responsibilities

Users are required to comply with the following rules when using Booksses:

1.Act in accordance with the law
2. Respect the rights of third parties
3. Not violate copyrights, trademark rights, or personal rights
4. Not share misleading or false information
5. Not perform actions that may disrupt platform security
6. Not harass, threaten, or target other users
7. Not engage in spam, abuse, or unauthorized automated activities
8. Not make false statements to access age-inappropriate content

Responsibility of Authors and Content Creators

Users who publish content on Booksses accept that they are fully responsible for the content they publish.

The author or content creator accepts that:

The content belongs to them or that they have the right to publish it.
The content does not infringe the copyrights of third parties.
The content complies with the law and community guidelines.
They will not share another person’s personal data without permission.
They are responsible for any legal claims that may arise in relation to the content.

Booksses is not required to review published content in advance. However, where deemed necessary, Booksses may review content, reduce its visibility, restrict access to it, or remove it.

Digital Content and Coin Usage

Some digital content on Booksses may be available free of charge. Some digital content may be accessed through coins, membership, payment, or another access method determined by the platform.

Coin is an in-platform digital value used within the Booksses platform for accessing digital content, unlocking chapters, or benefiting from certain digital services.

Coin is not cash, electronic money, a crypto asset, an investment instrument, or a general payment instrument replacing money.

By using coin to access digital content, the user does not acquire ownership of that digital content. The user only obtains a personal, limited, and non-transferable right of access.

Booksses reserves the right to change coin usage areas, campaigns, promotions, and access conditions.

Mobile Application Purchases

Some purchases related to digital content in the Booksses mobile application may be made through the Apple App Store or Google Play.

For these transactions, payment, refund, and cancellation processes may be subject to the policies of the relevant application store.

Physical Book Sales

Physical book products may be offered for sale on Booksses.

In physical book sales, the seller is the Seller Brand clearly specified on the relevant product detail page.

Booksses acts as an intermediary service provider in physical book sales.

The supply, packaging, delivery, invoicing, return, and withdrawal processes of the product are the responsibility of the relevant Seller Brand.

Booksses may assist in carrying out the request, notification, and communication process between the user and the Seller Brand.

Withdrawal and Return Processes

A consumer who purchases a physical book may exercise the right of withdrawal and return within the conditions specified under applicable legislation.

Withdrawal, return, delivery, and invoicing processes are carried out by the relevant Seller Brand.

Booksses may assist in forwarding the request to the relevant Seller Brand.

Prohibited Uses

The following actions are prohibited on Booksses:

1. Sharing unlawful content

2. Uploading content that infringes copyright
3. Publishing someone else’s content without permission
4. Attempting to access other users’ accounts
5. Disrupting the technical infrastructure of the platform
6. Performing unauthorized actions through bots, automation, or data scraping tools
7. Creating fake accounts
8. Acting on behalf of another person
9. Engaging in harassment, threats, insults, or targeted attacks
10. Using the platform for spam, misleading advertising, or fraudulent purposes
11. Engaging in behavior that may endanger child safety
12. Abusing the reputation, security, or operation of Booksses

Copyrights

Booksses respects copyrights and the rights of authors and creators.

Users may only upload content that belongs to them or that they have the right to publish.

Content reported for copyright infringement may be reviewed and, where deemed necessary, temporarily restricted or removed.

Responsibility arising from copyright infringement belongs to the user who committed the infringement.

Moderation and Account Actions

Booksses may take action regarding content and accounts in order to protect platform order, user safety, and copyrights.

Within this scope, the following actions may be applied:

1. Sending a warning

2. Requesting that the content be edited

3. Reducing the visibility of the content

4. Temporarily restricting access to the content

5. Removing the content completely

6. Temporarily suspending the account

7. Permanently closing the account

Limitation of Liability

Booksses makes reasonable efforts to provide platform services securely and without interruption. However, interruptions may occur due to technical failures, maintenance work, internet outages, third-party service provider issues, or force majeure events.

Booksses does not guarantee the accuracy, completeness, or legality of content created by users.

Booksses is not directly responsible for the supply, delivery, invoicing, or after-sales processes of physical products sold by the Seller Brand.

Right to Make Changes

Booksses may update these Terms of Use in line with changes to its services, technical requirements, or legal regulations.

The current text enters into force on the date it is published on the website.

The user’s continued use of the platform after the updated terms have been published means that the user accepts the updated terms.

Governing Law

The laws of the Republic of Türkiye shall apply to any disputes arising from these Terms of Use.

The rights granted to consumers under applicable legislation are reserved.
